These Terms of Service ("Terms") govern your use of the Stylist by Puzzlax mobile application ("App"), provided by Puzzlax Ltd. ("Puzzlax," "we," "us"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Your Account
To use most features of the App, you must create an account. You agree to:
- Provide accurate, current information
- Keep your password confidential
- Notify us immediately of unauthorized account access
- Take responsibility for all activity under your account
We may suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree NOT to:
- Use the App for unlawful purposes
- Upload content you do not have rights to
- Upload offensive, harmful, hateful, or sexually explicit images
- Attempt to reverse engineer, decompile, or hack the App
- Use automated tools (bots, scrapers) without our written permission
- Interfere with the App's operation or other users' experience
- Resell, redistribute, or commercially exploit App access without our permission
We reserve the right to remove content or terminate access for violations.
4. Your Content
You retain ownership of photos and content you upload to the App ("Your Content"). By uploading, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store, process, display, and back up Your Content
- Use anonymized, aggregated features of Your Content to improve our AI models (see Privacy Policy Section 5)
- Process Your Content via third-party services (OpenAI, Cloudinary) as described in our Privacy Policy
This license terminates when you delete content or your account, except for backups (retained up to 30 days for disaster recovery) and aggregated training data already incorporated.
5. AI-Generated Content
The App uses AI to generate clothing tags, outfit recommendations, and other suggestions ("AI Output"). AI Output:
- Is provided "as is" without warranty
- May contain inaccuracies or errors
- Should not be relied upon for critical decisions
- Does not constitute professional styling or fashion advice
You are responsible for evaluating AI Output before acting on it.
6. Intellectual Property
The App, including its design, code, logos, and content (excluding Your Content), is owned by Puzzlax Ltd. and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.
7. Subscriptions and Purchases
The App is currently free to use. We may introduce paid features in the future, with clear notice. If we do, the following will apply:
- Subscription terms will be presented at point of purchase
- Apple App Store / Google Play purchase terms will govern transactions
- Refunds are subject to Apple's / Google's policies, not Puzzlax directly
8. Third-Party Services
The App uses third-party services (OpenAI, Cloudinary, Railway, Apple App Store, Google Play). We are not responsible for the actions, content, or policies of third parties. Your use of third-party services is governed by their respective terms.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
We do not warrant that the App will meet your requirements, be error-free, or be available continuously.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUZZLAX LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold Puzzlax Ltd. harmless from claims, damages, or expenses arising from:
- Your violation of these Terms
- Your Content
- Your use of the App in violation of law
12. Termination
You may terminate your account at any time via App Settings or by contacting ilan@puzzlax.com.
We may suspend or terminate your access for violations of these Terms or for any reason with reasonable notice. Upon termination, sections that by their nature should survive (Sections 4, 6, 9, 10, 11, 13) remain in effect.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Israel, without regard to conflict of laws principles.
Disputes shall be resolved in the courts of Haifa, Israel, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
14. Changes to Terms
We may update these Terms. Material changes will be notified via in-app notice or email at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
